3. Use of Services

3.1 Eligibility

To use DeshCyber's services, you must:

  • Be at least 18 years old or have parental/legal guardian consent.
  • Not be restricted by cybersecurity regulations that prevent access to our tools.
  • Not engage in malicious, fraudulent, or illegal activity when using our services.

3.2 Authorized Usage

You may use our services for:

  • Cybersecurity protection, training, and compliance monitoring.
  • Threat intelligence, penetration testing, and security auditing within legal and ethical limits.

You are NOT allowed to:

  • Use our cybersecurity tools for unauthorized hacking, data breaches, or illegal activities.
  • Reverse-engineer, modify, or distribute our AI security technologies without permission.
  • Misrepresent or claim affiliation with DeshCyber without explicit authorization.

Violation of these terms may result in immediate termination of services and legal action.

4. AI-Powered Security & Compliance

DeshCyber integrates AI-driven cybersecurity frameworks into its services. While we ensure high security standards, you acknowledge that:

  • AI-based cybersecurity enhances threat detection but does not guarantee 100% protection.
  • Compliance solutions provided (e.g., PCI DSS, SWIFT CSP, ISO 27001 audits) are advisory and do not replace regulatory enforcement.
  • We are not responsible for cybersecurity incidents resulting from client-side misconfigurations or security lapses.

Your security strategy should include AI-enhanced automation AND human oversight.

5. Payment & Subscription Terms

5.1 Service Fees

All DeshCyber services (consulting, audits, AI security, training) are billed as per the agreed pricing model.

Billing Model:

  • One-Time Payments: For penetration testing, audits, and cybersecurity consulting.
  • Subscription Plans: For continuous AI-driven threat monitoring & compliance automation.

Failure to make timely payments may result in service suspension or termination.

5.2 Refund Policy

  • Refund requests are evaluated on a case-by-case basis.
  • No refunds for services already rendered or software licenses issued.
  • Clients must request a refund within 14 days of purchase for eligible services.

6. Confidentiality & Data Security

6.1 Data Privacy Commitment

DeshCyber follows GDPR, CCPA, PCI DSS, SWIFT CSP, and ISO 27001 compliance guidelines.

  • We do NOT sell user data to third parties.
  • Clients control their data and can request deletions or access logs.

6.2 Security Responsibilities

  • DeshCyber ensures AI-driven security monitoring and compliance enforcement.
  • Clients must configure their own security infrastructure correctly to prevent breaches.

Cybersecurity is a shared responsibility—clients must follow security best practices.

7. Limitation of Liability

DeshCyber is NOT liable for:

  • Cyberattacks, data breaches, or financial losses due to client-side misconfigurations.
  • Regulatory penalties if compliance recommendations were not implemented properly.
  • Service interruptions caused by external threats, force majeure, or third-party failures.

We offer risk mitigation, but NO cybersecurity solution is 100% invulnerable.

8. Termination of Services

DeshCyber reserves the right to terminate services if:

  • Users engage in malicious hacking, fraud, or illegal activities.
  • Users violate data protection laws or misuse AI-based security solutions.
  • Payments are not made within the agreed timeframe.

Termination does NOT relieve users of outstanding financial obligations.

9. Intellectual Property Rights

All content, AI algorithms, cybersecurity training materials, and proprietary technologies are the intellectual property of DeshCyber (Desh Technology Inc.).

Users MAY NOT:

  • Copy, reproduce, or redistribute proprietary AI-based security tools.
  • Claim ownership of DeshCyber security models, frameworks, or research.

Unauthorized use of DeshCyber intellectual property will result in legal action.

10. Governing Law & Dispute Resolution

All legal matters will be governed under the laws of the State of New York, USA.

  • Any disputes will be settled through negotiation, mediation, or arbitration before legal action.
  • Lawsuits must be filed in the jurisdiction of New York courts.

By using our services, you agree to resolve disputes under these legal frameworks.
